What Is Probate?
Probate is the legal process that takes place when a property owner passes away without a trust or transfer-on-death deed. The court supervises the administration of the estate to ensure debts are paid and assets — like real estate — are properly distributed to heirs or beneficiaries.
For real estate, probate often means the property must be appraised, marketed, and sold under court supervision. It can feel overwhelming, but with the right team by your side, the process is manageable — and even smooth.
The Steps in a Probate Real Estate Sale
- Court Appointment of Executor or Administrator
A personal representative (executor if named in a will, or administrator if not) is appointed to manage the estate. - Property Valuation
The court typically requires a probate referee to determine the fair market value of the property. - Listing the Property
With court approval, the executor works with a Realtor® (that’s us!) to prepare the property, set a pricing strategy, and launch marketing. - Buyer’s Offer & Court Confirmation
In many cases, buyers must wait for the court to confirm the sale. Other buyers may have the chance to bid at the confirmation hearing. - Closing the Sale
Once confirmed, the property closes escrow, proceeds go into the estate, and debts/beneficiaries are paid according to the court’s instructions.

- Timeline: Probate sales often take longer than standard sales due to court schedules.
- Control: Executors/administrators must follow probate rules and can’t always make quick decisions.
- As-Is Sales: Most probate sales are “as-is,” which reduces repairs but requires pricing strategy.
